Shipping Terms and Liabilities

Delivery & Proof

Once the shipment is delivered to the provided address, our contractual obligation is fulfilled. Proof of Delivery (POD) is available upon request and is considered conclusive evidence.

Delays

We are not liable for delays or non-delivery caused by circumstances beyond our control (Force Majeure).

Cargo Insurance

Customers may purchase parcel insurance to cover the declared value. You must determine the correct value and insure it accordingly.

Subrogation

If compensation is paid for a claim, we have the right to recover the amount from the responsible party.

Financial Conditions

  • You agree to pay all applicable service charges as per our shipping terms.
  • Invoices must be paid within the specified timeline.
  • Non-payment may result in shipment retention or suspension of services.

Liability and Indemnity

Limited Liability

Our services are provided “as is” and without additional guarantees. Our liability is limited to what is required under applicable law.

Indemnity

You agree to indemnify Unique Express for losses or claims arising from misuse, breach of terms, or prohibited shipment contents.

Banned Applications

  • Services must not be used for illegal or prohibited shipments.
  • Violation may result in immediate termination and legal action.
  • Detailed termination policy is available upon request.

Other Provisions

Jurisdiction

All disputes fall under the jurisdiction of Mumbai, Maharashtra. The applicable law is the law of India.

Limitations

Certain legal claims must be filed within the specified time frame.

Force Majeure

We are not responsible for delays caused by uncontrollable events such as natural disasters, riots, or government action.

Refund Policy

Refunds will be processed as per our refund rules when services cannot be delivered due to reasons beyond our control.
