Your Responsibilities and Account Information

Shipping Terms and Liabilities
a. Delivery and Proof of Delivery
- Once the shipment is delivered to the provided address, our contractual obligation is fulfilled.
- Proof of Delivery (POD) is available upon request and is considered conclusive evidence.
b. Delays & Non-Delivery
- We are not liable for delays or non-delivery caused by circumstances beyond our control (Force Majeure).
c. Cargo Insurance
- Customers may purchase parcel insurance to cover the declared value.
- You must determine the correct value and insure it accordingly.
- Liability for insured shipments is limited as per our shipping terms.
d. Subrogation
- If compensation is paid for a claim, we have the right to recover the amount from the responsible party.
Financial Conditions
- You agree to pay all applicable service charges as per our shipping terms.
- Invoices must be paid within the specified timeline.
- Non-payment may result in shipment retention or suspension of services.
Limitations of Liability and Indemnity
a. Limited Liability
- Our services are provided “as is” and without additional guarantees.
- Our liability is limited to what is required under applicable law.
b. Indemnity
- You agree to indemnify Unique Express for losses or claims arising from misuse, breach of terms, or prohibited shipment contents.
Banned Applications and Termination
- Services must not be used for illegal or prohibited shipments.
- Violation may result in immediate termination and legal action.
- Detailed termination policy is available upon request.
Other Provisions
a. Jurisdiction & Governing Law
- All disputes fall under the jurisdiction of Mumbai, Maharashtra.
- The applicable law is the law of India.
b. Limitations Period
- Certain legal claims must be filed within the specified time frame.
c. Force Majeure
- We are not responsible for delays caused by uncontrollable events such as natural disasters, riots, or government action.
d. Refund Policy
- Refunds will be processed as per our refund rules when services cannot be delivered due to reasons beyond our control.
